生活保護基準額の引き下げが憲法によって保障される生存権に違反するとして、受給者が減額処分の取り消しを求めた2件の訴訟について、24日に青森地裁と和歌山地裁で判決が出され、両地裁は処分の取り消しを認める判断を示した。
同様の訴訟は全国29地裁で起こされ、今回の判決で処分取り消しが認められた例は大阪、熊本、東京、横浜、宮崎の各地裁に続き、6例目と7例目となった。
国は2013年から2015年にかけて、物価下落などを理由に生活保護費のうち食費など生活扶助の基準額を引き下げ、約670億円の削減を実施した。
青森地裁の鈴木義和裁判長は、国の判断について「客観的数値などとの合理的関連性を欠き、専門的知見との整合性を有しないもので、判断の過程に過誤、欠落があるものと言わざるを得ない」と指摘。また、和歌山地裁の高橋綾子裁判長は、「厚生労働相の裁量権の逸脱、乱用があり、違法」と判断した。
