元東京地検特捜部副部長である弁護士の若狭勝氏が3月22日にフジテレビの情報番組「めざまし8」（月～金曜前8・00）に出演し、21日に東京都豊島区東池袋2丁目のマンションで発生した強盗事件について言及しました。
マンションの9階の一室に複数の男たちが押し入り、部屋にいた中国籍の男女を結束バンドで縛り、現金100万円を含む財物を奪って逃走しました。警視庁池袋署によれば、押し入った男のうち1人が、被害者の男性ともみ合いになった際に首を負傷し、搬送された病院で死亡しました。被害者の男性も軽いケガを負いましたが、女性にはケガはありませんでした。他の数人の犯人は逃走中で、警察は強盗致傷容疑で捜査を続けています。事件当時、部屋には会社社長の40代男性と従業員の30代女性がいました。
若狭氏は、「強盗の手口が一段と悪質化しているようだ」と指摘しました。また、「被害者が犯人の男1人を刺殺した場合、被害者が殺人罪に問われるかどうかという問題があるが、刑法の正当防衛だけでなく、盗犯や強盗などに関しては、刺し殺しても罪に問われない特別な法律が存在する。ただし、危険であるため注意が必要だ」と説明しました。
