2019年6月、大阪府吹田市の交番で警察官が包丁で襲撃され、拳銃が奪われた事件で、強盗殺人未遂などの罪に問われた36歳の男性被告に対する控訴審判決が大阪高裁で20日に行われました。大阪地裁の一審判決で懲役12年の判決が出ていたものの、大阪高裁はこれを破棄し、無罪（求刑・懲役13年）を言い渡しました。裁判長の斎藤正人は、精神疾患により心神喪失状態にあったとして、刑事責任能力がないとの判断を示しました。
被告は、「頭の中で『警察官を殺せ』との指示があった」と述べ、動機を説明した。公判では、統合失調症治療中だった被告の刑事責任能力の有無が争点となった。起訴前後に実施された2回の精神鑑定では、疾患の影響に関して異なる結論が出ていた。
被告は、2019年6月16日早朝、大阪府警吹田署千里山交番駐車場で、当時巡査だった古瀬鈴之佑巡査長（30）を包丁で刺し重傷を負わせ、実弾5発入りの拳銃を奪ったとして起訴された。
被告は、スマートフォンで交番の勤務態勢を調べ、事件後に服や所持品を捨てる一方で、逃走中に履歴書を購入する不自然な行動が確認されている。
大阪高裁は、被告の事件前後の行動や動機の説明を考慮し、起訴後の精神鑑定結果や精神科医の証言を重視し、「病気が計画や行動全てに影響していた」と判断した。また、「銃を奪おうとした動機は幻覚や妄想による極めて唐突で奇異なものだ」と指摘した。
斎藤裁判長は、「重い統合失調症の影響で善悪の判断ができない状態だった」と判断し、心神喪失者の行為は刑事責任を問わないとする刑法の規定に基づき、無罪と結論付けた。
一方、有罪とした大阪地裁判決は、被告の事件前後の動きについて、「臨機応変で合理的な行動をとっている」と判断し、限定的な刑事責任能力を認めていた。
